Legal Advisor , National Parliament of Timor-Leste


I. Profile of the Post
Project: Strengthening Institutional Capacity of the National Parliament in Timor-Leste
Title: Legal Advisor

II. Organizational Context
Timor-Leste became independent in 2002. A democratic semi-presidential governance system based upon separation of powers and mutual cooperation of the institutions of state was developed. The National Parliament is the cornerstone of the democratic system and good governance. It is currently comprised of 65 members. It is headed by the President of the National Parliament. Four political parties have constituted their benches. Detailed parliamentary scrutiny of legislation and government actions is delegated to seven standing committees of multi-party composition. The parliamentarians are supported in their work by a Secretariat of 99 permanent staff, headed by a Secretary General. . The Secretariat is divided into three directorates and twelve divisions, which assume responsibility for the work in general. This organizational structure is still being established following the new 2008 Law on the Organization and Functioning of the Parliamentary Administration (LOFAP).
The National Parliament was established from scratch, after Independence Restoration, in May 2002, in a setting of largely inexperienced parliamentarians; an acute shortage of skilled personnel and significant language barriers. Systems and processes are in the early stages, in some cases, and non-existent in others. Achievements are not yet consolidated and many challenges can only be overcome with long-term assistance. UNDP has supported the growth of the legislature since 2003.
The UNDP assistance to the Parliament consists of two projects:
A. Multi-donor project, Strengthening Parliamentary Democracy in Timor-Leste. This is a continuation of the previous two projects (2003-2005 and 2006-2009) and has a new project document for the period 2010-2013.
B. European Union (EU) funded project, Strengthening Institutional Capacity of the National Parliament in Timor-Leste. This is a new parliamentary capacity development project for which a project document has been signed for the period 2011-2015.
The objectives of the latest multi-donor project (2010-2013) are: (1) to support the consolidation of parliamentary processes by continuing to provide technical expertise and advisory assistance; (2) to expand and integrate existing capacity building initiatives into a comprehensive capacity development strategy; (3) on the basis of this capacity-development strategy and in close coordination with National Parliament, to articulate and lay the groundwork for a capacity transfer and national ownership over the project.
The objective of the EU-funded project is to enhance the Parliament’s ability to fulfil its mandate in overseeing the Executive by (1) enhancing institutional capacity and expertise of staff, and (2) enhancing the knowledge of Members of Parliament.
Within the framework of the UNDP Parliament Project, the Legal Advisor position will fall under the EU-funded project. A Letter of Agreement between UNDP Timor-Leste and the National Parliament of Timor-Leste will support the position.
III. Functions/Key Results Expected
The Legal Advisor to the National Parliament will provide legal technical support and advice to the parliamentary committees and support the implementation of the project capacity development strategy. The Legal Advisor will work under the direction of the UNDP Project Manager and indirect supervision of the Secretary General of the National Parliament of Timor-Leste. When necessary, the Legal Advisor will also be expected to work collaboratively with other Legal Advisors and sector-specific Technical Specialists.
The Legal Advisor will perform the following functions:
Summary of Key Functions:
  1. Advise, mentor, assist and develop legal capacity of the National Parliament in exercising its legislative function.
  2. Advise, mentor, assist and develop legal expertise of the National Parliament exercising its oversight function.
  3. Support the implementation of the project capacity development strategy.
  4. Support the UNDP Parliament Project.
Duties and Responsibilities:
  1. Advise, mentor, assist and develop legal capacity, knowledge and expertise of the National Parliament in exercising its legislative functions with a focus on the achievements of the following results:
    • Provide advisory services to Parliamentary Committees in analyzing draft bills.
    • Provide legal analytical and research support to the National Parliament.
    • Provide legal and technical guidance to Parliamentary Committees in conducting public hearings and in following-up on the recommendations arising from them.
    • Support Parliamentary Committees in drafting legal opinions and reports, as required.
    • Support Parliamentary Committees in the preparation and implementation of their annual work plans.
    • Advise the National Parliament on international best practice.
  2. Advise, mentor, assist and develop legal capacity, knowledge and expertise of the National Parliament in exercising its oversight functions with a focus on the achievements of the following results:
    • Provide legal support to all aspects related to Parliament’s oversight function, as required.
    • Assist in analyzing Budget proposals, Budget execution reports and Audit reports.
    • Assist Parliament in conducting Budget hearings and drafting budget reports.
    • Assist in organizing Committee visits and overseas trainings.
    • Provide legal research and analysis to support Parliament in assessing government performance.
  3. Support the implementation of the project capacity development strategy.
    • Assess systems and processes in the Parliamentary Support Directorate and make recommendations on areas of intervention.
    • Assess capacity development needs of Committee support staff and make recommendations on required activities and learning needs.
    • Engage with the Secretariat of the Parliament develop institutional systems and processes.
    • Engage with the Secretariat of the Parliament to develop skills and knowledge, and attitudes and behaviours of Committee support staff.
    • Develop and implement formal capacity development programmes.
    • Provide regular on-the-job training and mentoring to Members of Parliament and support staff, as required.
    • Provide regular mentoring and coaching to Secretariat staff as requested by the project.
    • Provide continual assessment on progress.
  4. Support the UNDP Parliament Project, with a focus on achievement of the following results:
    • Prepare and submit regular reports to UNDP through the Project Manager of the Parliament Project including compliance with monitoring and evaluation requirements: adviser logs, quarterly reports, annual reports, and ad-hoc inputs to Project reports.
    • Provide inputs to Project Work Plans relevant to his/her portfolio.
    • Participate in Project Meetings/workshops: Monthly meetings, team meetings, mid-term review meetings, and annual review meetings.
    • Undertake relevant tasks whenever required by the Project Manager.
IV. Impact of Results
• Legal capacities, skills and knowledge of MPs, Committees, and Secretariat staff strengthened through regular advisory support, on-the-job training and capacity development training programmes.
• Members of Parliament and technical staff enabled to effectively perform their legislative and oversight functions.
• Overall effectiveness of the Committees enhanced.
• Good situational awareness of the achievement of objectives through submission of regular progress reports to UNDP (Weekly Logs, Quarterly Reports, and Annual Reports).

VI. Recruitment Qualifications
Education
• Advanced degree in law (civil law) or related field or equivalent.
Experience
• Minimum eight years of experience at the senior level in supporting legislative processes.
• Experience in Public Finances an advantage.
• Parliamentary experience essential.
• Demonstrated experience in capacity building, coaching, mentoring and staff development preferably in a developing country environment.
• Demonstrated experience in providing advisory services, research and analysis.
• Knowledge of the legal system of Timor-Leste desirable.
• Work experience in a government context desirable.
• Experience working in developing and post-conflict country environment highly desirable.
Language Requirements
• Excellent command of written and spoken Portuguese is essential.
• A good standard of written and spoken English is required.
• Knowledge of Tetum or Bahasa Indonesia is an advantage.
• Successful completion of an intensive Tetum course within the first month of assignment is mandatory.

Senior Program Manager, PFMCBP Ministry of Finance (MoF) Dili, East Timor

The Ministry of Finance (MoF) through the Public Finance Management Capacity Building Program (PFMCBP) is seeking applications from qualified international Consultants to fill the position of Senior Program Manager, PFMCBP to provide effective program management, implementation, and supervision of the PFMCBP based on the Project Appraisal Document for the Program and the legal agreements between the Government of Timor Leste and the World Bank.
 
Funded by a grant from the International Development Association and a World Bank administered multi-donor trust fund (with contributions from AusAID, EC, Irish Aid, New Zealand and Norway), the PFMCBP is a coordinated program of targeted capacity building in planning and financial management. The Program started in late 2006 provides technical assistance to sustainably strengthen planning, budgeting, public expenditure management and revenue administration for growth and poverty reduction, with emphasis on efficiency, effectiveness, accountability, integrity, service culture, and transparency. After a successful five years of operation, the program has been extended to 30th November 2012 and is currently under negotiation for a second extension until 31 December 2013. After this point it is not envisaged that the PFMCBP project will continue in its current form but that future support will be integrated into the ongoing Direct Budget Support program to the Ministry.
 
PFMCBP has assisted the Government of Timor-Leste through the Ministry of Finance to take forward an important reform agenda. Key achievements include implementation of a major reorganization of the Ministry of Finance; strengthening public expenditure management through simplification and strengthening of treasury systems and processes, and increased delegation of authority to line ministries; complete overhaul of budgeting systems, documentation and financial management legislation; improved revenue management, including increased transparency in tax administration and reinforcing Petroleum Tax administration; and a gradual improvement in macroeconomic planning. There are important challenges ahead as the Ministry of Finance implements a strong reform program in a capacity constrained environment. PFMCBP itself has a challenge to build capacity and enable an increased transfer of responsibility to Timorese public servants.
 
The Ministry of Finance is responsible for the strategic management of PFMCBP, through its Consultative Committee on Financial Management (CCFM) chaired by the Minister of Finance. A dedicated Program Implementation Unit is part of the newly established National Directorate for Managing External Support within the Directorate General for Corporate Services of the MoF that is responsible for day-to-day program management and implementation of all external support to the Ministry. Australia, the EC and Norway continue to have bilateral programs with the Ministry of Finance as well as contributing to the multi-donor program. The Asian Development Bank and Japan also provide assistance to the Ministry.
 
A Supervisory Committee of donors to PFMCBP, also chaired by the Minister of Finance, provides regular oversight on program implementation and achievements. The World Bank is responsible for program supervision, to ensure it is aligned with agreed objectives and financing agreements.

I. Selection Criteria
Essential
·            Demonstrated ability to provide team leadership and management.
·            At least twelve years senior project management experience, preferably as project team leader, in developing countries with a track record of establishing and implementing systems and processes for operations, financial management, performance management, procurement and evaluation.

III. Scope of Work
The Senior Program Manager will assist the Program Implementation Officer,who has delegated authority from the Minister of Finance to execute the Legal Agreements between the Government of Timor Leste and the World Bank.
 
The Senior Program Manager will manage the operational staff of the PIU, which comprises three other covenant positions –the Finance Officer the Senior Adviser Human Resource and Capacity Building, the Procurement Officer. A number of other positions and service contracts are also under the control of the PIU for which this position is responsible. S/he shall also work closely with the National Directorate for Managing External Support to the MoF (NDMES), DGCS in supporting the Ministry program as outlined in the Strategic Plan and the Ministry 5 Year Plan.
 
The Senior Program Manager will also facilitate the closure of the project by the end of January 2014 and the handover of any ongoing responsibilities into the NDMES.
 
The position involves project management, implementation and supervision and provision of corporate services support, as follows:
 
Program Management Functions
·            Participate on the Consultative Council for Finance Management, chaired by the Minister, during sessions that the CCFM is convened to address issues relating to the PFMCBP. The CCFM shall act as the Steering Committee of the PFMCBP
·            Provide secretariat support to the Supervisory Committee, which meets at least every six months
·            Work closely with Directors General, Senior Management Advisers, and the Minister’s Office in coordinating timely program inputs
·            Manage the effective recruitment and management of a large team of consultants,
·            Prepare Annual Reports and Quarterly Reports of the Program for submission to the Minister of Finance and donors of the Program  
·            Prepare Implementation Action Plans and ensure that these are updated every six months
·            Prepare Procurement Plans, updated every six months
·            Prepare report against the Results Matrix
 
Operation and Supervisory Functions
·            Manage the recruitment process for international and national consultants
·            Manage the Advisers’ Performance Management System
·            Manage administrative support for consultants such as inductions and leave
·            To assist the NDMES in its mandate to support the management of all external support to the Ministry
·            Liaise with the World Bank office to help it undertake effective program supervision
·            Ensure that procurement is aligned with Government’s observed procedures and managed in accordance with World Bank operational procedures
·            Ensure that the Program finances are administered using Government’s systems and managed in accordance with World Bank operational procedures
·            Ensure that the legal agreements between the Government and the World Bank are observed
 
Corporate Services Support
·         Work closely and provide support to the work of the NDMES, DGCS, particularly in promoting partnerships with Development Partners interested in supporting the MoF
·         Assist the NDMES in aligning bilateral and/or multilateral support projects (including the PFMCBP) to the MoF to help establish and then use Government’s internal systems and procedures to ensure greater institutional strengthening of the MoF 
·         Work with NDMES to establish a coordination mechanism with Development Partners of MoF that will ensure the efficient and effective utilization of donor support to the MoF.
 
 IV. Key Deliverables
·            Within four weeks of commencement, develop an Assignment Work Plan that is consistent with the relevant activities and performance indicators of the Ministry’s 5 Year Plan
·            Annual Reports and Quarterly Reports on the outcomes and impact of the PFMCBP and its efforts in building capacity within the Ministry of Finance.
·            Implementation Action Plan and Procurement Plan
·            Timely  recruitment and efficient management of consultants under the Program
·            Quarterly Progress Reports to the Director-General for Corporate Services, approved and endorsed by the Project Implementation Officer, against the agreed Work Plan
·            By the end of the contract period have successfully concluded the PFMCBP project and facilitated the movement of ongoing support to the Direct Budget Support Program being implemented by the Ministry
·            End of Assignment report to the PIO no later than 10 working days prior to the end of contract
 
 V. Performance Evaluation
 
Performance of the Senior Program Manager will be assessed by the Project Implementation Officer, the Director General of Corporate Services, in accordance with the performance review framework for advisors in place in the Ministry.

MCHIP Timor-Leste Operations Manager-- Dili, Timor Leste


MCHIP is the USAID Bureau for Global Health's flagship maternal, neonatal and child health (MNCH) program, which focuses on reducing maternal, neonatal and child mortality and accelerating progress toward achieving Millennium Development Goals (MDGs) 4 and 5.
Imunizasaun Proteje Labarik (IPL) is a Millennium Challenge Corporation threshold project, managed by USAID and implemented by MCHIP. IPL works with the MOH and other partners to raise immunization coverage in Timor-Leste. The current project dates are April 2011-June 2013. The IPL project seeks candidates for an Operations Manager position in Dili, Timor-Leste. The Operations Manager is supervised by and will support the IPL Chief of Party (COP) in managing and coordinating all finance, administrative and logistics-related activities for IPL, and in supervising and supporting its team of Administrative and Finance staff. The overall responsibility is to implement project strategy and support the project team in line with organizational rules and regulations to achieve the project goal.
The JSI office in Dilli, Timor Leste houses the USAID IPL and the bilateral Health Improvement Project (HIP, or HADIAK in the local vernacular). IPL and HADIAK share office costs and space, and they use some of the same office equipment. The IPL Operations Manager and HADIAK Administrator will work together to manage the shared office space and equipment, and to make decisions that will or could affect members of both project teams. Each project will have its own separate finance admin and operations manual, based on JSI and USAID policies and regulations and tailored to the terms of the project agreement. The IPL and HADIAK Chiefs of Party will participate in decisions about the organization, use and maintenance of shared office space and equipment only when this is necessary to resolve issues that cannot be resolved by the IPL Operations Manager and HADIAK Administrator on their own.

RESPONSIBILITIES

Specific responsibilities and tasks of the position include:

Financial Management
  • Develop annual budget for operations support, with guidance / feedback from the Home Office. Assure that budgets accurately reflect approved workplans.
  • Participate in development of the budget for technical activities.
  • Monitor expenditures and provide notice to the Country Director of variances from projected expenditures
  • Oversee the work of the Project Accountant, ensuring that costs are within IPL, JSI, USAID, USG, and other donor rules and regulations and are properly documented
  • Provide guidance on financial policies and procedures to project staff
  • Monitor the local bank account
  • Review and sign off on all IPL vouchers, purchase orders, quotations, and expenditures (including salaries, advances, allowances, travel claims and other payments to staff, vendors and other claimants).
  • Oversee monthly financial reporting, assuring accuracy and timely submission; review the Quickbooks database and all vouchers, ensuring completeness and accuracy; verify bank account reconciliation and petty cash reconciliation at end of each month
  • Serve as the primary point of contact for the Home Office Program Officer and liaison with the Finance Team to resolve any disallowed vouchers and respond to queries

Administration/Contract Management

  • Ensure that established policies and guidelines are adhered to, specifically for HR, finance, administration and security protocols (maintain the local version of the JSI Employee Handbook, ensuring that it is compliant with all applicable rules and regulations)
  • Coordinate and manage the administrative/logistics teams and systems
  • Ensure program logistics are at optimal efficiency to allow for productive and smooth implementation.
  • Ensure international and local procurement reflects USAID and JSI policy and is compliant with guidelines and regulations.
  • Ensure appropriate, transparent and cost efficient procurement, stocking and distribution of project supplies.
  • Maintain inventories and controls over IPL fixed assets, such as furnishings and computer equipment, and submit these to Washington at least quarterly
  • Oversee and monitor IPL equipment and vehicles, renewal of vehicle registration and insurance
  • Uphold control mechanisms to monitor the use of vehicles, generators, etc. particularly fuel consumption, spare parts and replenishment/service scheduling.

Human Resources Management

  • Supervise staff assigned to the IPL Administrative and Financial Team, establish clear work objectives, conduct timely and effective performance appraisals, provide coaching and feedback, and support staff development opportunities, professional growth
  • Ensure that timesheets for staff are submitted. Conduct reviews of the timesheets for accuracy and completeness and the achievement of organizational objectives.
  • Oversee administration of personnel policies (local hire manual) and ensure JSI/USAID regulations and procedures, as well as local labor laws are adhered to for recruitment, benefits, and personnel matters.
  • Oversee the preparation of local payroll and benefits, administer benefits plan and maintain current standing with all mandated tax and registrations, including submission of payments and required reports
  • Ensure that technical staff requests for and reconciliations of travel advances are complete and submitted on time; also ensure that the Accounting Team processes travel advances and reconciliations in a timely manner
  • Assist COP in security management by acting as security focal point for IPL and ensure that security guidelines are respected and followed by IPL staff
  • Assist COP in developing, reviewing and maintaining adequate security systems including evacuation plans, security guidelines and preparedness procedures; if necessary facilitate the evacuation of field based teams in collaboration with the COP.

QUALIFICATIONS

  • Bachelor’s in finance, accounting, business, economics or related field with a minimum of 7 years direct work experience in financial, grants or contracts management.
  • Prior experience managing USAID grants or contracts.
  • Demonstrated knowledge of USAID rules and regulations.
  • Proven expertise in finance, accounting and auditing, including automated financial systems, financial planning and reporting, oversight of local vendors and subcontractors, monitoring of contract compliance, and establishment and management of internal financial controls.

Corporate Services Adviser - Timor-Leste

The Government of Timor-Leste seeks a Corporate Services Adviser to develop and mentor the new telecommunications regulator, the Autoridade Nacional de Communicações (ANC)

With a new Decree-law on telecommunications and two new operators the Government of Timor-Leste, supported by AusAID and the World Bank, seeks an adviser to develop and support the new regulator, the ANC. This ‘hands on’ role will help establish the new regulator, equipping it with efficient administrative systems, tools and procedures so that it can effectively carry out its statutory functions.

The Corporate Services Adviser will be part of a team of advisers. He or she will mentor the new ANC Board and develop the ANC’s human resource capacity through skills transfer to the ANC’s local staff.

REQUIRED EXPERIENCE AND QUALIFICATIONS

The Corporate Services Adviser will be expected to have:

  • a suitable tertiary qualification in business or public administration;
  • prior senior corporate services management experience, ideally in a regulatory body;
  • demonstrated experience in developing administrative policies, systems and procedures in financial, staff, property and assets management, preparing budgets, annual reports and work plans, and human capacity development;
  • mentoring skills to develop ANC corporate administration practices; and
  • excellent writing and speaking skills in English and, ideally, Portuguese.

The Technology Adviser will be one of a team of advisers supporting the ANC in all its statutory functions, including the making of regulatory measures, and in developing its human resource capacity.

REQUIRED EXPERIENCE

The Technology Adviser will be expected to have:

  • substantial senior experience in a telecommunications and radio communications regulatory technology role, ideally in emerging markets and in a telecommunications operator;
  • demonstrated experience with technology issues concerning radio spectrum, numbering and Internet Domain management, an understanding of the development of a national radio spectrum plans, technical standards and approval arrangements and the role of the International Telecommunication Union and other international standards bodies;
  • mentoring skills to assist the ANC develop internally the technical skills it needs; and
  • excellent writing and speaking skills in English and, ideally, Portuguese.

He or she should also:

  • be familiar with telecommunications issues of developing countries;
  • possess wide knowledge of modern technical regulation in the context of developing countries;
  • ideally have knowledge and experience of telecommunications sector issues in the South Pacific region and/or other small island economies.

With a new Decree-law on telecommunications that requires cell site sharing between operators the Government of Timor-Leste, supported by AusAID and the World Bank, seeks a Cell Site Sharing adviser to develop and support the new regulator, the ANC, in its cell site sharing related functions. This ‘hands on’ role will help, in relation to cell site sharing, establish the organisation and credibility of the regulator; facilitate rapid network expansion in the newly liberalised environment; mentor the new ANC Board and develop skills of ANC staff.

The Cell Site Sharing Adviser will be one of a team of advisers supporting the ANC in all its statutory functions, including the making of regulatory measures, and in developing its human resource capacity.

REQUIRED EXPERIENCE

The Cell Site Sharing Adviser will be expected to have:

  • 10 years’ experience in cell site and tower management and must have demonstrated experience of actual cell site and tower sharing negotiations, ideally in emerging markets;
  • demonstrated experience of pricing cell site and tower sharing;
  • strong skills and experience relevant for resolving informal and formal disputes - ideally, having participated in mediation, arbitration and adjudication processes;
  • mentoring skills, to assist the ANC develop cell site sharing related skills; and
  • excellent writing and speaking skills in English and, ideally, Portuguese.

He or she should also:

  • be familiar with mobile telecommunications issues of developing countries; and
  • ideally have knowledge and experience of mobile tower and cell site issues in the South Pacific region, small island states and/or other developing countries.
